Neither you nor Najahat will seek to hear any Dispute as a class action or in any other proceeding in which either party is acting or proposing to act in a representative capacity. No arbitration or proceeding will be consolidated with another proceeding without the prior written consent of all parties to all affected arbitrations or proceedings.

 

60. Arbitration procedure

Arbitration shall be either through arbitrators at the Kuwait Lawyers Association Arbitration Center, or at the International Arbitration Center in Kuwait, or through legal arbitrators from lawyers, with the knowledge of Najahat platform, and the other party must accept this and not object to it.

61. Arbitration fees

The second party shall pay the expenses of the arbitration if it is found that he has breached the obligation, but in the absence of such breach, the expenses shall be his right. The only exception to this is when the arbitrator decides that one of the parties is entitled to recover his fees from the other party.

Arbitration fees: Whoever files an arbitration case, the second party must pay the fees if he is in breach of his commitment, unless he obtains an exemption from the fees according to the applicable arbitration rules.
